Terms of Service

1. Acceptance of Terms

By accessing or using Wintura ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Wintura is an AI-powered proposal and Statement of Work (SOW) generator designed for marketing agencies. The Service uses artificial intelligence to generate proposal content based on client briefs you provide.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. Subscription & Billing

Wintura offers a free tier (3 proposals per month) and paid subscription plans. Paid plans are billed monthly through Stripe. You can cancel your subscription at any time through the Settings page — cancellation takes effect at the end of the current billing period.

Prices are subject to change with 30 days' notice. We will not retroactively change pricing for active subscriptions without consent.

5. Content Ownership

Your content: You retain full ownership of all client briefs you submit, proposals generated, and agency profile information. Wintura does not claim any intellectual property rights over your content.

AI-generated content: Proposals generated by the AI are work-for-hire created for you. You have full rights to use, modify, distribute, and sell the generated proposals.

Responsibility: You are responsible for reviewing all AI-generated content before sending it to clients. Wintura does not guarantee the accuracy, completeness, or suitability of generated proposals.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Submit content that is defamatory, obscene, or infringes on third-party rights
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Use automated tools to scrape or bulk-generate proposals beyond your plan limits
• Share your account credentials with unauthorized parties
• Resell access to the Service without written permission

7. Limitations of Liability

The Service is provided "as is" without warranties of any kind. Wintura is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue from proposals that do not win clients.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using Wintura, you consent to the collection and use of information as described therein.

9. Termination

You may terminate your account at any time. We may suspend or terminate your account for violations of these Terms, with notice when reasonably possible. Upon termination, your data will be retained for 30 days before permanent deletion, unless you request immediate deletion.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 15 days before taking effect. Continued use after changes constitutes acceptance.
